Foreign insurers can be sanctioned by host supervisors, EU top court rules

( January 22, 2026, 10:11 GMT | Official Statement) -- MLex Summary: Host country insurance supervisors may impose penalties on insurers operating cross-border without first completing the Solvency II cooperation procedure with the home authority, provided certain conditions are met, the EU’s top court has ruled. While the cooperation mechanism applies where breaches are identified, host supervisors may directly impose penalties that do not concern authorization conditions and do not deprive insurers of their right to conduct business in the host country, the court said.Judgment attached.
