Banco Popular bondholder lawsuits can proceed against Santander, EU top court says

( September 11, 2025, 08:01 GMT | Official Statement) -- MLex Summary: Investors who acquired Banco Popular’s bonds and brought legal actions before the bank’s resolution in 2017 can enforce those rights against Banco Santander, the EU’s top court said. The Spanish Supreme Court had asked the Court of Justice of the EU to clarify whether such pre-resolution claims were barred under EU banking resolution rules. The court held that actions for annulment or damages brought before resolution are considered “accrued rights” and remain enforceable against the successor entity, Banco Santander.
