Amex's remuneration to KLM is caught by EU card-fee caps, legal opinion says

( March 6, 2025, 11:22 GMT | Official Statement) -- MLex Summary: EU caps on card fees limit the "total net amount of payments, rebates or incentives" paid by American Express to airline KLM, even though the latter is not a card issuer, according to a non-binding legal opinion prepared for the bloc's top court. At issue in the EU Court of Justice case is the interpretation of a 2015 law known as the Interchange Fee Regulation that caps fees at 0.3 percent for credit cards operated by “four-party systems” such as Visa and Mastercard. Amex is a “three-party system” that manages the transaction itself and is mostly outside the scope of the law.The advocate general's opinion in case C-549/23 is attached....
