Costco must face trimmed claims in case over health data, US judge rules

( November 14, 2024, 22:24 GMT | Official Statement) -- MLex Summary: Costco must face some claims accusing it of illegally tracking and sharing its customers' health data with digital ad companies, a Washington federal judge ruled. US District Judge John H. Chun denied a motion to dismiss as to claims under the Wiretap Act, the Health Insurance Portability and Accountability Act, and other privacy laws, saying the URLs used and disclosed by Costco constitute “contents” of a communication for consumers’ prescription searches. Chun concluded that plaintiffs’ failure to allege that Costco installed the Pixel on webpages viewed after an individual logs into their patient portal is immaterial.
