National Labor Relations Board memo to regional offices says 'overbroad' non-compete agreements are unlawful

( May 30, 2023, 17:45 GMT | Official Statement) -- MLex Summary: National Labor Relations Board General Counsel Jennifer Abruzzo told regional directors, officers-in-charge and resident officers that the proffer, maintenance and enforcement of non-compete provisions in employment contracts and severance agreements violate the National Labor Relations Act except in limited circumstances. According to the memo, "overbroad" non-compete agreements are unlawful because they chill employees from exercising their rights under Section 7 of the NLRA, which protects employees’ rights to take collective action to improve their working conditions.
