​ABA suggests Australia reconsider adopting 'concerted practices' concept in antitrust law

( November 1, 2016, 02:36 GMT | Official Statement) -- MLex Summary: The American Bar Association’s antitrust and international law sections have suggested that Australia reconsider plans to introduce the concept of “concerted practices” into its competition law, and instead follow the Australian Competition and Consumer Commission’s initial suggestion to just expand the scope of “contract, arrangement or understanding” in the existing law. The ABA noted that the experience of other jurisdictions in this concept shows numerous difficulties in delineating harmful and actionable conduct from procompetitive or benign ones. However, if Australia decides to adopt it, the ABA provided comments to help the ACCC draft more detailed guidelines. The association's statement is attached....
