Facebook's reliance on T&Cs for data processing lawful under EU's GDPR, Austrian court says

( December 29, 2020, 17:31 GMT | Official Statement) -- MLex Summary: Facebook's reliance on its terms and conditions as providing a legal basis for data processing under the EU's strict General Data Protection Regulation has been been found lawful by the Vienna Higher Regional Court. The tech giant argued that in line with EU rules the T&Cs form a contract, and the processing of personal data is necessary for its performance. The judgment sparked fury from Austrian privacy campaigner Max Schrems who called it an attempt to "bypass" a more robust consent requirement under GDPR. He added he would appeal the court's decision, and ask for the question to be referred to the EU's top court. Separately, Facebook was ordered to give Schrems full access to his data, and pay 500 euros for "emotional damages" caused by its persistent refusal to do so.Statement follows.
