EC Statement: Taxation - Commission formally requests Belgium to change its law on taxation of capital gains

( April 6, 2011, 10:25 GMT | Official Statement) -- MLex Summary: The European Commission has asked that Belgium amend its law on the taxation of capital gains because they breach EU rules on the freedom of establishment to public services and free movement of capital. The Commission found that the the law discriminates against assets outside Belgium.The European Commission has formally requested Belgium to amend its rules concerning the taxation of capital gains because they discriminate against assets outside Belgium and so breach basic EU Single Market rules (freedom of establishment, freedom to provide services and free movement of capital). The Commission's request takes the form of a "Reasoned Opinion" (second step of EU infringement proceedings). In the absence of a satisfactory response within two months, the Commission may refer Belgium to the EU's Court of Justice....
