Comment: Brazil's CADE adopts pragmatic stance, harmonizing anticorruption and competition laws in shantytown probe

In April, the Tribunal of the Administrative Council for Economic Defense, or CADE, addressed a bid-rigging cartel investigation in the shantytown construction sector by levying fines on construction companies, taking into account penalties previously paid to the anticorruption agency. On April 17, Brazil's competition authority imposed fines on construction companies Álya Construtora, Coesa (formerly OAS), and Delta Construções as part of a bid-rigging cartel investigation linked to shantytown construction in Rio de Janeiro. This ruling (see here) provided insights into how competition law intersects with anticorruption legislation, emphasizing the need to align sanctions and legal interpretations in cases where both laws apply simultaneously....
