Banks must refund consumers with part of loan fee under certain conditions, EU’s top court says

( October 17, 2024, 10:18 GMT | Official Statement) -- MLex Summary: A consumer can recover part of the commission linked to the granting of credit if he or she hasn’t been informed that the fee isn’t dependent on the duration of a mortgage contract, the EU Court of Justice rules today. The same applies to cases where a consumer has paid the commission in a single instalment when concluding a mortgage agreement. Today's ruling follows a referral from a court in Warsaw over how to interpret the directive on credit agreements for consumers as part of a dispute pitting Santander Bank Polska against a consumer.Press release follows.
