ABA sections comment on JFTC's proposed changes in its surcharge system

( July 27, 2017, 07:57 GMT | Official Statement) -- MLex Summary: The American Bar Association's antitrust law and international law sections have released joint comments regarding the Japan Fair Trade Commission's "Antimonopoly Act Study Group Report on the Surcharge System."  The ABA report, written both in English and Japanese, was in response to the JFTC's proposed revisions to the surcharge system released in English on April 25. In that report, a JFTC study panel called for a more flexible system of surcharges, saying that the current mechanism was "rigid" and that the JFTC should have some discretion in determining surcharges on a case-by-case basis. In their June 29 report, the ABA sections commend the JFTC's plan to revise the surcharge system and recommend that guidelines for determining surcharges be clear. The ABA report also says, among others, that surcharges are appropriate only for "hard-core" cartel conduct, such as price fixing and bid rigging and that such surcharges should be based on a thorough analysis of the effects of the violation.The report is attached. ...
