US SEC needs to bring FCPA cases more quickly, enforcement division co-director says

( November 9, 2017, 21:18 GMT | Official Statement) -- MLex Summary: The US Securities and Exchange Commission must focus on bringing Foreign Corrupt Practices Act cases to court before the statute of limitations expires, said Steven Peikin, co-director of the SEC's enforcement division. He said the SEC may not toll time under the Speedy Trial Act while it is waiting for information from foreign authorities, unlike the Justice Department, which may do so. Peikin also noted the recent Kokesh v. SEC Supreme Court decision requiring that the SEC obtain disgorgement judgements within a statute of limitations. Peikin said the full impact of that ruling remains to be seen, but it does indicate a need to prosecute cases sooner.Speech follows:...
