US importers file challenge to Trump's 122 tariffs

( March 9, 2026, 23:06 GMT | Official Statement) -- MLex Summary: Two US importers filed a lawsuit at the Court of International Trade challenging the Trump administration's use of Section 122 of the Trade Act of 1974 to impose a global 10 percent tariff. Burlap and Barrel, Inc., and Basic Fun, Inc., represented by the nonprofit public interest law firm Liberty Justice Center, said the Section 122 tariffs can be used to impose duties, but only "under specific circumstances that do not currently exist," alleging the US illegally claimed there was a balance-of-payments concern despite the conditions not being met by the current economic state of the country. They also alleged that the Trump administration violated the non-delegation doctrine that prevents Congress from delegating its core powers.See attached complaint....
