EU appeals WTO ruling over Chinese use of anti-suit injunctions in SEP disputes

( April 24, 2025, 12:08 GMT | Official Statement) -- MLex Summary: The European Commission appealed a recent WTO panel decision in its case against China over the use of anti-suit injunctions by Chinese courts. The dispute concerns how China handles standard-essential patent enforcement — particularly court orders that prevent foreign companies from pursuing patent litigation outside China. The commission claims the WTO panel misinterpreted several key provisions of the TRIPS Agreement, including those on exclusive rights, licensing, and enforcement. The EU is asking WTO arbitrators to overturn those findings and conclude that China’s ASI policy and five specific court decisions violate global trade rules. The appeal will be reviewed through the multi-party interim appeal arbitration agreement process, with a final ruling expected by July.See appeal notificaion attached....
