US states file amicus brief in support of FTC in Meta monopoly suit

( May 29, 2026, 21:42 GMT | Official Statement) -- MLex Summary: The District of Columbia and 28 US states filed an amicus brief in the Federal Trade Commission's appeal of a lower court order finding Meta Platforms did not illegally monopolize the personal social networking services market, saying the court made an error requiring the FTC to show a current or imminent antitrust violation in 2025 when the order was handed down. In a filing to the US Court of Appeals for the DC Circuit, the states said the district court’s interpretation of Section 13(b) of the FTC Act risks eroding proper enforcement of the antitrust laws. "Establishing liability at the time of filing of the complaint deters anticompetitive conduct by would-be wrongdoers, even if no equitable remedy is deemed necessary. Further, if the district court’s interpretation stands, it will fragment State and FTC competition enforcement by requiring different standards for establishing antitrust liability, which will squander law enforcement and judicial resources," the brief said.See attached document...
