FTC moves to dismiss Media Matters suit in US court

( April 15, 2026, 23:55 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission has moved to dismiss a lawsuit from Media Matters that aims to block the agency's investigation into the progressive news organization, claiming FTC investigative subpoenas were a retaliatory investigation that violated the US Constitution. "To begin, the Court lacks subject-matter jurisdiction over pre-enforcement challenges like this," the FTC said in moving to dismiss Media Matters' claims.  "For nearly a century, an uninterrupted line of cases from the Supreme Court and courts of appeals has rejected pre-enforcement challenges to federal agency CIDs and subpoenas." Media Matters' constitutional claims also fail, the FTC said, because "it lacks an implied cause of action, under either the First Amendment or the FTC Act, to bring this claim.  And in any event, it did not exhaust the claim by raising it in an administrative proceeding before the FTC, as it was required to do."See attached document....
