Live Nation seeks interlocutory appeal, stay of trial in US DOJ monopoly suit
( February 22, 2026, 23:30 GMT | Official Statement) -- MLex Summary: Live Nation Entertainment and Ticketmaster have filed a motion to stay and to certify an interlocutory appeal in a monopolization lawsuit brought by the US Department of Justice and several US states and the District of Columbia following US District Judge Arun Subramanian's recent summary judgment order. The court decided two critical questions of law on which there is substantial ground for disagreement, and the resolution of each would dramatically change and substantially narrow the upcoming jury trial, Live Nation said. The court explicitly held that plaintiffs do not need evidence of actual price discrimination to prove their alleged targeted customer markets in this actual monopolization case, and implicitly held that plaintiffs can proceed with a tying claim without a properly defined market for the tied product. As this court acknowledged, the only other court to decide the first question in an actual monopolization case has reached the opposite conclusion.
