US DOJ files statement of interest in Disney SEP suit against InterDigital

( October 7, 2025, 19:34 GMT | Official Statement) -- MLex Summary: The US Department of Justice's Antitrust Division filed a statement of interest in Disney's litigation over reasonable and non-discriminatory licensing of video compression technology against InterDigital, which is seeking to dismiss the case. "In reviewing the Complaint here, the court should decline any invitation to rely on conclusory allegations to presume that the elements of a rule-of-reason claim are satisfied," the Antitrust Division said. "In particular, the Court should not find market power to be adequately alleged simply on the basis of SEP status; nor should it conclude that allegedly charging high prices, by itself, harms competition," it said. The court also shouldn't deem protected petitioning activity a violation of the antitrust laws, it said. The DOJ said it takes no position on the resolution of the motion to dismiss, but is filing the statement to explain how courts have applied the antitrust laws to standards-development activity.See attached document....
