Multinationals should lose Belgian tax exemption appeals, EU court opinion says

( March 26, 2026, 11:44 GMT | Official Statement) -- MLex Summary: A Belgian tax program that exempted certain "excess profits" of Belgian companies as being part of multinationals was correctly identified by the European Commission as illegal state aid, according to an opinion for the EU's top court. The regulator rightly found that the program granted selective advantages, EU Court of Justice Advocate General Juliane Kokott said, recommending judges fully reject four appeals grouping actions brought by companies including Soudal, ZF, Zoetis and St. Jude Medical. In three appeals, including by Dow, AB InBev and BASF, she said the court should overturn a requirement that Belgium recover the aid from the broader corporate group, rather than from the subsidiary that benefited.The opinions are attached.
