In a judgement published late on Thursday, the tribunal, led by Judge Michael O’Bryan, found that Coles had a reasonable opportunity to respond to the Australian Competition & Consumer Commission’s concerns before the June decision. The tribunal did allow Coles to file evidence by Oct. 2. on alleged errors in the ACCC’s business case and revenue calculations.
