India refines foreign investment policy for land-bordering countries

The latest update to the country's consolidated foreign direct investment policy provides legal clarification on investments originating from countries that share a land border with India. It says beneficial ownership applies to any individual or entity that ultimately owns, controls, or derives economic benefit from an Indian investment, regardless of whether it is routed through third-country intermediaries. Under the revised criteria, an investment is classified as originating from a land-bordering country if restricted citizens or entities exceed statutory ownership thresholds, exercise control over the investor, or maintain ultimate effective control over the Indian investee, according to a statement issued by the Ministry of Commerce & Industry on Sunday. The revised regulations will take effect upon notification under the Foreign Exchange Management Act (FEMA), 1999.Statement attached...
