HPE-Juniper judge explains denying states’ bid for hold separate order in Tunney review

( January 27, 2026, 13:05 GMT | Official Statement) -- MLex Summary: Twelve US states and the District of Columbia have asked the court reviewing the Department of Justice's settlement with Hewlett-Packard and Juniper for a hold separate order, which would require the companies to cease any further integration efforts until the court completes its review. The court denied the states’ motion orally on Jan. 8, and said Monday it denied the motion because the relief would extend well beyond the relevant market to encompass all of HPE and Juniper’s operations. And second, because the states did not move for relief until several months after the court had authorized the companies to begin integrating their operations, and the alleged irreparable injuries to competition “have almost certainly already occurred, and the states didn't identify any specific, further harm that is likely to occur before this court is able to issue any Tunney Act decision.”See file attachment. ...
