Proposed Dutch merger call-in powers might be too broad, advisory body says

( October 7, 2025, 13:35 GMT | Official Statement) -- MLex Summary: Proposed Dutch rules — allowing the Autoriteit Consument en Markt to "call in" small but concerning mergers that don’t meet review thresholds — might be too broad, according to the Council of State. This council, which serves as an advisory body to the government and lawmakers, questioned whether the powers need apply to all sectors, when until now, concerns have been raised only about markets for general practitioners, vet practices and childcare. The Council of State also questioned whether the ACM was better placed to intervene in healthcare mergers than the NZa, the national health authority.Statement follows, in Dutch.
