Appeal judges also clarified costs during revocation appeals and UPC competence over pre-grant non-infringement actions.This week the Unified Patent Court’s appeal judges clarified that the automatic suspensive effect of a revocation appeal does not extend to related costs, in a dispute between the Chinese Academy of Military Medical Sciences and Gilead Sciences. The Court of Appeal also held in Sidel v Omnia that the UPC can have competence over a non-infringement action filed before a patent was granted....
