Entertainment and Disney, saying that the studio’s opposition is full of red herrings and unpled or readily contradicted mischaracterizations of its service. Midjourney argued that the studios, at most, cobble together conclusory allegations, unreasonable inferences, and third-party conduct not attributable to Midjourney — none of which, individually or collectively, amounts to “clear” and “affirmative” encouragement of infringement required under Supreme Court precedent.See attached file. ...
