UPC appeal rulings set unified framework for holistic inventive step test

Litigants now have greater legal certainty over the court's holistic method, to be further clarified alongside upcoming European Patent Office guidance.Assessing inventive step at the Unified Patent Court will now follow a clearer and more predictable framework after the court’s top judges used two appeal rulings — Amgen v. Sanofi and Regeneron, and Edwards v. Meril — to establish a unified, “holistic” test that litigants can expect to shape disputes going forward....
