The EU Court of Justice ruled today that an “informed user” should be the standard when judging whether aspects of one modular system infringe the design protections of another modular system. The court’s conclusion, which also found that infringement occurs even when relatively few parts of the contested modular system are at issue, hands a victory to LEGO over Chinese manufacturer Qman....
