The UPC also upheld its position on costs when both parties are partially successful.This week the UPC handled two cases concerning late action on the part of patent holders. Johnson & Johnson subsidiaries Cilag and Ethicon saw their application for provisional measures against Rivolution dismissed after the court found that companies had been aware of Rivolution"s activity for months but had taken no action. And Centripetal had its application for a discretionary review of a prior decision by the Mannheim division rejected after the court determined that it had delayed its application....
