National law can’t exceed EU’s Trademark Directive, top court rules

( August 1, 2025, 11:04 GMT | Official Statement) -- MLex Summary: National law can’t override the EU’s Trademark Directive, the EU's top court said in a preliminary ruling today. The directive ensures that registered trademarks receive the same level of protection across all EU member states, and national courts cannot go beyond the limits set out in the EU's directive, the court said. The response comes as part of a dispute between Lunapark Scandinavia and Hardeco Finland, where a national rule based on general principles of private law would have barred enforcement due to inactivity. Lunapark retains the right to enforce its "Dracula" trademark, despite its prior inactivity, the court ruled.
