Vantiva takes aim at Blackberry’s IEEE commitment in SEP dispute with Malikie

In the US filing, the domestic subsidiary of France’s Vantiva SA says commitments to the Institute of Electrical and Electronics Engineers can be imparted to assignees — and that Malikie Innovations Ltd. and Key Patent Innovations Ltd. failed to live up to commitments made by Blackberry, from whom they were assigned 32,000 patents in 2023. Although IEEE bylaws lend support to Vantiva’s position, US courts are less clear.On the heels of a burgeoning global enforcement campaign by the monetizers of a sizable portion of Blackberry Ltd.’s patent portfolio, at least one defendant is pushing back....
