Jurisdiction over pre-launch patent disputes in XSYS v Esko affirmed by UPC

By Inbar Preiss ( June 2, 2025, 14:31 GMT | Insight) -- A challenge by print and packaging company XSYS has been rejected by the Unified Patent Court’s appellate judges, who confirmed that the UPC has jurisdiction over alleged patent infringements that occurred both before the UPC Agreement took effect, and during a previous opt-out period. The case was brought by Esko-Graphics Imaging over a European patent covering a method for curing photo-curable printing plates.
