USPTO denies Shopify PTAB challenges, citing new Hulu standard

By Nick Robertson ( May 30, 2025, 16:54 GMT | Insight) -- Shopify’s petitions for inter partes review of e-commerce patents owned by DKR Consulting were denied yesterday at the Patent Trial and Appeal Board, with a panel of administrative patent judges finding that the challenged patents’ claims had already been found invalid by a US district court, justifying discretionary denial despite an ongoing appeal. The three denials are among the first times the board has cited April’s Hulu v. Piranha Media Distribution denial decision, which was designated as precedential earlier this month.The Patent Trial and Appeal Board denied three inter partes review petitions citing to the newly designated precedential Hulu v. Piranha Media Distribution decision yesterday. The panel wrote that Shopify’s challenges to ecommerce patents owned by DKR Consulting should be denied as the challenged claims had already been found invalid by a US district court, despite an ongoing appeal....
