US federal judge grants jurisdictional discovery in online copyright dispute

While Haynes North America failed to demonstrate that the court has specific jurisdiction over Delaware-based online retailer eManualOnline.com, Haynes’s difficulty in locating the online retailer is “good cause” to expedite discovery to establish that eManualOnline targeted the state, in a case with implications for enforcement of intellectual property rights against online merchants.A California federal judge left the door open to a finding of jurisdiction in a copyright and trademark infringement suit despite denying Haynes North America’s motion for a preliminary injunction on jurisdictional grounds on Friday.
