Copyright case by Envoy over software usage by Cubic falls flat in US

To succeed on a theory of direct copyright infringement, Judge Stanley R. Chesler said Envoy was required to plead with specificity which Cubic computers ran Envoy’s “XIPC” program outside the bounds of the parties’ agreements, which date back to 2002. Because the complaint by Envoy fails to make that showing, its related claims of vicarious and induced infringement also fail.Envoy Technologies’ copyright litigation against licensee Cubic Corp. will not be advancing, with US Judge Stanley R. Chesler of the District of New Jersey yesterday deeming the allegations fatally deficient....
