Rejection of BDSwiss’s international trademark request confirmed by EU court

( May 14, 2025, 08:31 GMT | Official Statement) -- MLex Summary: The EU General Court has upheld the EUIPO’s refusal to forward BDSwiss’s international trademark application, as the company had failed to prove it had a “real and effective industrial or commercial establishment” in the EU — a requirement under the Madrid Protocol. BDSwiss based its claim on a Cypriot subsidiary, but only provided statements from its own director. The court ruled this insufficient and rejected BDSwiss’s request to annul the decision and compel EUIPO to transmit the application to the World Intellectual Property Organization.The judgment is attached in French.
