In US trade secret row, Insulet wins look at EOFlow’s financial position

( May 7, 2025, 13:51 GMT | Official Statement) -- MLex Summary: US District Judge Dennis Saylor IV of the District of Massachusetts granted a request by Insulet for post-verdict discovery on EOFlow’s finances — a bid EOFlow opposed as premature and overbroad. In April, Saylor slashed by order of magnitude a jury’s $452 million verdict on its trade secret claims against the South Korean medical device maker, on the grounds the bulk of that award would be an impermissible double recovery with the terms of a global permanent injunction Saylor also entered in the case. Insulet, maker of the “Omnipod” insulin-patch pump, argued earlier this year that EOFlow’s ability to pay up is in doubt, entitling it to post-verdict discovery. Saylor agreed, granting the plaintiff access to EOFlow’s finances as well as updates on EOFlow’s ongoing arbitration proceeding with Medtronic PLC, which could potentially yield a “break-up” fee.See attached document....
