UPC Court of Appeal reverses Milan decision in Insulet v EOFlow dispute

The injunction bans EOFlow from manufacturing, marketing, or distributing the infringing insulin pump devices using this patent across 17 UPC member states pending a final ruling expected around December. The decision was founded on strict claim construction, a demonstrated likelihood of infringement, and the risk of continued market disruption.The Court of Appeal of the Unified Patent Court granted a preliminary injunction in favor of US-based Insulet Corporation, reversing an earlier denial by the Milan Central Division....
