Bayer wins nearly $1 million summary judgment against US soybean farmer

By Nick Robertson ( April 21, 2025, 15:56 GMT | Insight) -- An Eastern District of Missouri judge granted Bayer Cropscience’s motion for summary judgment against a soybean farmer, awarding nearly $1 million in liquidated damages and granting a permanent injunction after the farmer admitted to replanting seeds for three years in violation of a terms-of-use agreement, infringing Bayer patents. Greg Duffy initially alleged that Bayer’s licensing scheme was anticompetitive and his agreement was under duress, but those arguments were held to be abandoned. Judge John Ross found the damages provision in the terms of use agreement to be reasonable.A southeast Missouri soybean farmer must pay nearly $1 million in liquidated damages to Bayer Cropsciences and subsidiary Monsanto Technology, a US Eastern District of Missouri judge ruled Friday, granting the companies’ motion for summary judgment for the infringement of soybean seed patents and finding the per-unit liquidated damages provision of the parties’ agreement reasonable....
