UPC denies Aylo’s bid to introduce US submissions in video-streaming patent row

( April 17, 2025, 08:13 GMT | Official Statement) -- MLex Summary: Adult entertainment platform Aylo has been denied permission to submit additional arguments by the Unified Patent Court, in a case concerning its infringement of EP 2,479,680 related to video streaming. The Mannheim Local Division rejected Aylo’s Rule 9.1 application, which sought to introduce statements made by DISH Technologies in related US proceedings over patent US 8,868,772. Aylo argued that these submissions conflicted with DISH's current claims before the UPC and supported Aylo’s interpretation of key patent features. However, the court held that differing views in separate foreign proceedings were not admissible for interpreting the patent-in-suit. It also ruled that Aylo had failed to justify why the information could not have been presented earlier in the proceedings.See court document in German attached....
