Syngenta allowed to expand infringement claim following BSH ruling

( April 15, 2025, 13:56 GMT | Official Statement) -- MLex Summary: The Unified Patent Court has granted permission to Syngenta to amend its infringement claim concerning EP 2,152,073 to include Czechia, Poland and the United Kingdom. The Munich Local Division held that Syngenta could not have been reasonably expected to include these non-UPC states in its original filing, due to jurisdictional uncertainty that prevailed until February this year, when the EU's top court published its BSH Hausgeräte v. Electrolux ruling. The UPC panel concluded that the legal clarity provided by that ruling justified the timing of Syngenta’s application. The procedural timetable was adjusted accordingly, but Sumi Agro's request for leave to appeal was denied.See UPC document attached....
