Damages not prohibited in default judgment if figure not listed, US Ninth Circuit rules

By Nick Robertson ( April 14, 2025, 16:58 GMT | Insight) -- The US Court of Appeals for the Ninth Circuit ruled Friday that damages in default judgment under the Lanham Act aren't prohibited if the plaintiff didn't specify a dollar figure in the complaint. Damages aren't barred by Rule 54(c), the panel held, vacating and remanding a Central District of California ruling in a false advertising suit.Air filtration system manufacturer AirDoctor isn't prohibited from receiving damages in a false advertising suit which ended in default before trial, the US Court of Appeals for the Ninth Circuit ruled Friday....
