AirDoctor default judgment reversed; US Ninth Circuit says damages not barred

( April 14, 2025, 16:56 GMT | Official Statement) -- MLex Summary: The US Circuit Court of Appeals for the Ninth Circuit vacated and remanded a Central District of California default judgment in a Lanham Act false advertising suit, with the panel holding that AirDoctor is not prohibited from receiving damages. Judge George Wu of the Central District of California ruled that he could not award damages because of Rule 54(c), as AirDoctor did not specify a dollar amount in its complaint. But the panel held that AirDoctor's demand for actual damages to be determined at trial allows the court to award damages in an appropriate amount, despite not having a specific figure.See opinion attached....
