Roku’s foreign counsel tells US court UPC may not reach Frand question

By Melissa Ritti ( April 14, 2025, 15:49 GMT | Insight) -- In a declaration submitted last week in support of his client Roku’s opposition to a request by Dolby and Sun Patent Trust for dismissal or, alternatively, a stay of its US lawsuit seeking a declaration of fair, reasonable and nondiscriminatory license terms to various standard essential patents, Andreas Kramer cast doubt on Roku’s ability to secure that relief elsewhere. According to the Vossius partner, there is “no controlling precedent by the Court of Appeal of the UPC that the UPC can assume jurisdiction for FRAND related counterclaims.”Roku last week pushed back on claims by Dolby International and Sun Patent Trust that a Massachusetts federal court lacks jurisdiction over its request for a declaration of fair, reasonable and nondiscriminatory, or Frand, license terms to patents purportedly essential to the High Efficiency Video Coding standard....
