Codeberry can’t amend defenses in UK copyright, contract row with IDDQD

By Melissa Ritti ( March 27, 2025, 11:41 GMT | Insight) -- A UK High Court judge has blocked an attempt by Codeberry and its founder Lee Paul Smith to defend allegations of copyright infringement by software company IDDQD Ltd. by putting the plaintiff in the hot seat. In so ruling, Judge Richard Hacon agreed with a Chancery Master that the proposed laches defense — supported only by a witness statement from Smith, himself — “does not go nearly far enough to substantiate the relevant plea.”IDDQD has successfully defeated an application by Codeberry and Lee Paul Smith for leave to amend their defense in a copyright infringement and breach of contract action....
