Brewery Paulaner wins trademark case over cola-mix packaging in Munich court

( March 25, 2025, 15:46 GMT | Official Statement) -- MLex Summary: The Munich Regional Court has ruled in favor of brewery Paulaner, prohibiting its rival Brauerlimo from using a similar five-color wave design for its cola-mix beverage in Germany, according to a press release. The court found that the contested packaging closely resembled Paulaner Spezi’s protected trademark and could mislead consumers about the product’s origin. The defendant argued that colorful packaging is common in the market and that its design was merely decorative. But the court rejected this, emphasizing that the extensive use of the color scheme across cans, bottles and advertising served as a brand identifier. "Such extensive use of a color combination is no longer understood as a mere background or decorative element, but rather conveys to the public the impression of an independent significance as a labeling element," the judges said.See press release in German attached....
