US appeals court, in rare en banc sitting, will rehear dispute over patent damages

By Nick Robertson ( March 12, 2025, 19:42 GMT | Comment) -- Google and EcoFactor will square off tomorrow at an exceedingly rare event — en banc rehearing by the full US Court of Appeals for the Federal Circuit.  The court tasked with hearing all appeals arising under federal patent law agreed last fall to take a second look at a June 2024 decision by a three-judge panel confirming a $20 million award against Google in connection with its use of EcoFactor technology in the Nest smart thermostat products.The US Court of Appeals for the Federal Circuit will sit tomorrow for a rare en banc review, taking a second look at the damages awarded to EcoFactor in its smart thermostat patent dispute with Google....
