'BABEK' trademark valid, UK court says, rejecting challenge by Iceland Foods

( March 12, 2025, 18:21 GMT | Official Statement) -- MLex Summary: The UK High Court granted summary judgment to Babek International and against Iceland Foods on Iceland’s claim “BABEK” is invalid as a figurative trademark. According to Judge Richard Hacon, as of the date of registration, UK trademark No. 907527963 was sufficiently clear and precise from the perspective of “both the competent authorities and of the public,” thus satisfying the standard articulated in s.1(1) of the 1994 Trademarks Act. In so ruling, Hacon rejected various positions advanced by Iceland, including that because the description of the trademark included the word “embossed,” it implies entitlement to protection as a 3D sign. Hacon said he found no ambiguity, adding, “I think the reader would have understood that the embossing effect is of principal significance in relation to the BABEK writing, and so it appears from the visual representation.”See attached document....
