Viral DRM has standing in US under DMCA but not Copyright Act

By Melissa Ritti ( March 4, 2025, 11:08 GMT | Insight) -- Viral DRM, an extreme weather video content syndicator, lacks standing to sue for copyright infringement under the Copyright Act because it is not the legal owner or exclusive licensee of the content. However, VDRM has standing to bring claims under the Digital Millennium Copyright Act as a person injured by alleged DMCA violations, US Judge William Orrick of the Northern District of California ruled. An agreement that gives Viral DRM, a syndicator of videographic content, a non-exclusive right “to display, store, and transmit” works created by videographers who cover extreme weather, does not transfer ownership of the videos to VDRM and, therefore, does not confer standing on VDRM to pursue copyright infringement claims under the Copyright Act, a US judge ruled last week....
