Walgreen abandons reconsideration bid, settles trademark row with PWNHealth

( February 26, 2025, 17:17 GMT | Official Statement) -- MLex Summary: A stipulation of dismissal with prejudice was entered yesterday in the US District Court for the District of Delaware, just over one week after Walgreen asked Judge Richard Andrews to reconsider his Feb. 10 refusal to set aside a $987.6 million arbitration award in favor of PWNHealth. In his ruling, Andrews rejected Walgreen’s allegations of arbitrator bias. At issue in the case were allegations that Walgreen during the summer of 2021 continued to use the ‘PWNHealth’ trademark in connection with Covid-19 test orders and results, despite processing those test orders and results in-house. The parties partnered during the early days of the pandemic, at which time Covid-19 tests could only be ordered by a physician. PWN — which maintains a network of telehealth providers — was acquired by Everly Health Inc. in March 2021 for $400 million and now does business as Everly Health Solutions.See attached document....
