The judgment reinforced the principle that the lower-tier court may not adopt a position on issues that the EUIPO Board of Appeal has not considered, and in so doing appears to bring greater legal certainty.An EU Court of Justice ruling in a trademark dispute between Neoperl and the EU Intellectual Property Office has strengthened procedural certainty for trademark applicants and other parties, by reaffirming the roles of the EU courts and institutions over evidence examination in trademark appeals....
